And the child-care workers were investigated for assault? You don't discipline your child and then turn it loose on the general population to create chaos and mayhem? I think the parents haven't used a big enough stick on him yet. Here's looking at the next rioter coming up through the ranks. My regular readers are of an age where we never even THOUGHT about doing something like this.
Revised 14:01: I distinctly remember the very first (and LAST) temper tantrum that I threw. The family was shopping and I went into it full bore. For the life of me I can't remember what it was all about, but I DO remember the outcome. I was immediately hauled to my feet, my ass was tanned right there and I was removed from the store and placed in the truck to wait until the rest of the family was finished shopping. For a kid it seemed that I was out there by myself for hours, but I'm fairly certain it was no more than a half hour or so. Was that abuse? Not even a little bit. I learned my lesson and never pulled a stunt like that again.
Taping child to chair not assault, judge rules
WINNIPEG — Two Winnipeg daycare workers have been cleared of criminal wrongdoing for taping a three-year-old boy to his chair in an attempt to control a temper tantrum.
The pair had been charged with assault for the 2009 incident but walked free this week following a trial in provincial court.
"This is a very difficult issue people feel strongly about. In this context, and under these circumstances, I'm not prepared to call upon criminal sanctions," said Judge John Guy.
Crown and defence lawyers had presented an agreed statement of facts to Guy, only disagreeing about how the circumstances of the incident should be interpreted by the court.
The three-year-old boy was one of about 14 children who were at the daycare and being supervised by three workers and the director.
But the situation became chaotic when the director left to go to the bank and the boy — who had a history of behavioural issues — demanded his pants be changed because they were soiled. When told by the daycare staff he'd have to wait a minute, he picked up a chair and threw it towards a group of other children, court was told.
Two of the workers told the boy he would be taped to the chair if his bad behaviour didn't stop immediately. When he picked up another chair, they followed through on the threat.
The tape was loose enough that the boy was able to quickly free himself, but the two workers repeated the process. The tape was removed about three minutes later when the director returned from her errands and was alarmed by what she saw, court was told.
The boy's parents were notified about the incident and they contacted police. Officers launched an investigation and ultimately authorized the assault charges after consulting the Crown. The boy was not physically injured.
Defence lawyers argued their clients had the best interests of all the children at heart and were not acting in a malicious or vindictive way.
The judge agreed, saying "context is important" in a case such as this. He also suggested daycares have conversations with child welfare officials about the protocols in place to handle situations of out-of-control children to ensure these types of cases aren't repeated.

So... I got a haircut while I'm here in Lubbock today (anything to kill time...) and I had to wait while some two year old was getting his hair cut, and not his first one, either. The child SCREAMED throughout the whole haircut, so much so that passers by in the mall looked in to see who was killing a child. Mom just held him and cooed to him throughout the whole episode.
ReplyDeleteNow I know you cannot reason with two year olds and you really shouldn't beat the shit out of a child that young. But a good slap on the ass might have wonders for the kid's attitude.
Just sayin'.
And yeah, Deb... I had manners and good behavior as a kid, too. Because I KNEW the consequences...
